Inauguration Will Bring ChangesThe upcoming Presidential inauguration will signal the beginning of a notable shift in the business climate of the United States.
Discussions on issues such as Card Check are everywhere.
Other changes loom out there as well.
Senator Christopher Dodd is likely reintroduce the Re-empowerment of Skilled and Professional Employees and Construction Tradeworkers (RESPECT) Act. This change would amend the National Labor Relations Act (NLRA) to modify the definition of a supervisor under the Act regarding their rights to join a labor union.
Another lesser know piece of legislation that may come up again is the Independent Contractor Proper Classification Act, introduced by President-Elect Barack Obama in September 2007. This bill would require that employers treat workers classified as independent contractors as employees for employment-tax purposes. This bill would impact companies like FedEx that use large numbers of independent contractors to perform work for them.
The thing that concerns me the most is the possible introduction of the concept of Interest Arbitration into private sector collective bargaining as part of the proposed Employee Free Choice Act (EFCA). This would alter the standard rules of bargaining considerably, and would not be a positive step, in my view.
